Transportation

Casey Gilson represents railroad, trucking, shipping, logistic and intermodal companies throughout the state of Georgia and the Southeast.  The claims we evaluate and defend typically involve catastrophic personal injury, wrongful death, and significant property damage.  When called upon, we travel day or night to the scene of an accident to ensure that witnesses, evidence, and information critical to a successful defense are properly captured.  Our attorneys are accustomed to directing on-scene investigations of serious and often fatal injury accidents.  These same investigating attorneys follow the case to conclusion.

We are designated core counsel by and represent one of the largest Class I railroads in the country.  We also represent many of the major short line railroads in the Southeast.  In our railroad representation, we handle grade crossing accidents, wrongful death, trespasser injuries, third party claims, real property damage issues, hazardous materials issues, occupational illness claims and traumatic injury claims (made pursuant to the Federal Employer's Liability Act), claims arising from derailments, and the acquisition of real property for railroad expansion.  Our practice representing railroads pits us against some of the best trial lawyers in the country.  Many of our railroad cases involve innovative legal and evidentiary issues.

We represent national and local motor carriers and their insurers, as well as the intermodal industry in catastrophic injury and wrongful death claims relating to commercial motor vehicles.  We have been involved in a wide array of motor carrier claims and freight claims, as well as the representation of specialized carriers hauling oversized or super heavy loads and the defense of claims for cargo loss and damage.  Casey Gilson attorneys also represent cargo interests and cargo underwriters on subrogated claims.  Our attorneys provide coverage opinions for clients on a multitude of trucking and non-trucking issues, such as primary/excess insurance coverage disputes, application of the MCS 90 endorsement, application and effect of uninsured/underinsured motor coverage, as well as the stacking of insurance policies.

Our attorneys are active in many transportation related professional organizations, including the National Association of Railroad Trial Counsel, Intermodal Association of North America, Atlanta Claims Association, Georgia Self Insurers Association, Inc. and America's Independent Trucking Association, Inc.
