Intellectual Property

Intellectual property (IP) is a broad term used to describe various legal entitlements which attach to names, written and recorded media and inventions. It is imperative that intellectual property rights are properly registered with the appropriate federal office. Failure to make proper registration will often times lead to the inability to obtain the full money damages and injunctive relief provided by federal law. The firm's IP practice focuses on the protection and enforcement of our clients' intellectual property rights both through transactional work and litigation.

Transactional Work

The firm regularly represents clients in a broad range of intellectual property matters, assisting them in acquiring and protecting their ideas and innovations. Our attorneys have extensive experience in various transactional matters including:

  • Negotiating and drafting software and website design and development agreements.

  • Drafting agreements for websites, including privacy policies, copyright policies, delivery policies, refund policies and terms of use.

  • Preparation of applications to register copyrights.
  • Preparation of applications to register trademarks and service marks.

  • Drafting and negotiating privacy and publicity rights releases

Litigation

Intellectual property disputes often result in the filing of  litigation involving a wide range of complex issues.  Our clients benefit from the firm's extensive litigation and trial experience in, and familiarity with, the federal court system.  Our IP litigation practice includes cases involving patents, trademarks, service marks, copyrights, trade secrets, and privacy and publicity rights.
